Ancient Sculptures

Terms and Conditions

1 Seller and contact details

The website ancient-sculptures.com is operated by Luca Lizzani, VAT number 07067331004, with business address at Via Benedetto XIV 3, 00165 Rome (RM), Italy.

For orders, assistance, complaints, withdrawal requests or transport damage, the customer may contact the Seller at info@ancient-sculptures.com.

References to Ancient Sculptures, the Seller or the website refer to the online sales activity carried out by Luca Lizzani through ancient-sculptures.com.

2 Website, customers and scope of these Terms

ancient-sculptures.com is an e-commerce website for the direct sale of antique, artistic and decorative items offered by Ancient Sculptures, including sculptures, paintings, antique table tops and similar objects. The website is not a marketplace, auction platform or intermediary for third-party sellers.

These Terms govern browsing, orders, sales, payments, invoicing, shipping, insurance, delivery, returns, withdrawal rights where applicable, complaints and all purchases made through ancient-sculptures.com. By using the website or submitting an order, the customer accepts these Terms.

The website may be used by consumers, professionals, companies and international customers. A consumer is a natural person purchasing for purposes unrelated to business, commercial, craft or professional activity. A professional is a natural or legal person purchasing in the course of such activity. Mandatory consumer rights always remain unaffected.

An Order is the purchase request submitted through checkout. Submitting an Order does not constitute automatic and definitive acceptance by the Seller. A Definitive order confirmation is the communication by which the Seller definitively accepts the Order after the necessary checks. Automatic order receipt emails do not constitute definitive confirmation unless expressly stated.

3 Products, product pages, photographs and condition

Ancient Sculptures sells antique, artistic and decorative items. Products may be unique, antique, restored, fragile, valuable, used or non-standardised.

Each product is described on the basis of information available at publication. Depending on the item, the product page may include type, material, period, attribution, provenance where available, dimensions, weight, condition, restorations, visible defects, missing parts, integrations, certificate or documentation, price and shipping information.

The customer must carefully read the product page, examine photographs and consider the nature, age and condition of the item before submitting an Order. Photographs form part of the product description, but colours, tones and visual perception may vary due to lighting, photographic settings, screen calibration and device used, without constituting lack of conformity where essential characteristics are not materially altered.

Antique and artistic objects may naturally show signs of age, restoration, patina, wear, abrasions, cracks, chips, colour variations, integrations, missing parts, material irregularities or fragility. Characteristics expressly disclosed before purchase shall not be considered hidden defects or lack of conformity merely because they are present in the product.

If the customer believes that the product materially differs from the product page, photographs, certificate or documentation, the customer must contact info@ancient-sculptures.com with the order reference, description of the alleged discrepancy and photographic evidence. Mandatory rights remain unaffected.

4 Certificates, documentation, authenticity and attribution

Each product is accompanied by a certificate or documentation relating to the individual item. Its content and scope may vary according to the product and available information.

Depending on the case, the document may concern description, material, period, attribution, provenance, condition, authenticity, restoration history or other expressly stated elements. The customer must rely only on what is expressly stated in the product page and in the document provided for the specific product.

References to period, origin, attribution, school, style, provenance or historical context must be interpreted according to the wording used. Terms such as attributed, estimated, probable, in the style of, period or based on available documentation do not constitute absolute guarantees unless expressly stated in writing.

5 Orders, availability and definitive acceptance

Many products may be unique or available in one quantity only. Availability shown on the website is updated with care but may require verification after Order submission.

After receiving an Order, Ancient Sculptures verifies product availability, payment, customer data, shipping feasibility, insurance, additional costs, customs requirements and any legal, regulatory or documentary restrictions.

Ancient Sculptures may refuse, suspend or cancel an Order if the product is unavailable, an evident error is detected, payment is invalid or unverifiable, customer data are incomplete, shipping costs require adjustment, shipment is not possible, or restrictions, permits or authorisations prevent sale or delivery. Any refundable amounts already paid will be reimbursed.

6 Prices, payments, invoicing and retention of title

Product prices are displayed on the website or during checkout in the amount and currency indicated at the time of purchase. VAT, taxes and fiscal treatment are handled according to applicable tax rules and information displayed on the website, product page, checkout or tax document.

Accepted payment methods are those displayed during checkout. Payment or attempted payment does not constitute automatic and definitive acceptance of the Order. Ancient Sculptures may verify payment validity, customer details, payer identity and any irregular, disputed, reversed, incomplete, unverifiable or potentially fraudulent payment.

Unless expressly included, customs duties, import taxes, local taxes, customs clearance costs, bank collection costs, transfer fees, currency conversion fees, payment provider fees, storage costs, re-delivery costs and other third-party charges are borne by the customer where due and permitted by law.

If a cost cannot reasonably be calculated in advance because it depends on the product, destination, shipping method, packaging, insurance, customs procedure, authorisation or third-party charge, Ancient Sculptures may communicate it after verification. The Order will not be definitively accepted until the relevant cost has been communicated and, where necessary, accepted by the customer.

The customer must provide accurate information for invoices, tax documents, shipping documents and, where applicable, customs or export documents. Ownership of the product passes to the customer only after full payment of the product price, shipping costs and any accepted additional costs, and after definitive acceptance of the Order by the Seller.

7 Shipping, packaging, insurance and worldwide delivery

Ancient Sculptures offers international shipping subject to logistical, insurance, customs, legal and documentary feasibility. Shipping methods and costs may vary according to type, size, weight, fragility, value, destination and packaging requirements.

Where shipping costs are displayed at checkout, the customer must review them before submitting the Order. Ancient Sculptures may verify such costs after receiving the Order if the product, destination, packaging, insurance, carrier requirements, customs procedures or authorisations require it.

For products requiring quotation or verification, the Order is not definitively accepted until the shipping method, cost and applicable additional costs have been confirmed. If updated costs or conditions are not accepted by the customer, Ancient Sculptures may cancel the Order and refund any amounts due.

Ancient Sculptures may use professional packaging, custom crates, pallets, reinforced packaging, specialised carriers or dedicated transport. All shipments are insured according to the terms, limits, procedures and conditions applicable to the individual shipment. Transport insurance does not guarantee unlimited coverage for all events, damages, losses, delays, exclusions, deductibles or indirect consequences.

Special packaging, handling, storage, insurance, customs or transport costs not expressly included are borne by the customer where due and permitted by law.

8 Customs, import/export, cultural property and restricted materials

International orders may be subject to customs duties, import taxes, local taxes, clearance costs, inspections, import/export documents, licences, permits, authorisations or restrictions imposed by the country of departure, transit or destination.

Unless expressly included, duties, taxes, charges and costs imposed by authorities, couriers, customs agents, banks, payment providers or other third parties are borne by the customer where due and permitted by law. The customer must provide accurate information and cooperate with Ancient Sculptures, carriers, customs offices and authorities where required.

Due to the antique, artistic or collectible nature of certain products, some items may be subject to laws, checks or documentation requirements relating to cultural property, archaeological objects, historical items, protected materials, export, import or circulation of goods. Materials such as ivory, coral, tortoiseshell, protected woods, animal-derived materials or other regulated materials may be subject to restrictions where present.

Ancient Sculptures does not guarantee that every product can be shipped, exported, imported or delivered to every country. If shipment, export, import or delivery is not lawfully, logistically, commercially or reasonably possible, the Order may be suspended or cancelled and any amounts due will be refunded.

9 Delivery, customer cooperation, transport damage and risk

The customer must provide a complete, accurate and accessible delivery address and all information needed for shipping, delivery, customs and contact with the carrier.

Upon delivery, the customer must check the external condition of the packaging. If the packaging appears damaged, opened, wet, crushed or altered, the customer should sign with reservation where available and permitted by the carrier.

In case of visible or suspected transport damage, the customer should promptly contact info@ancient-sculptures.com with the order reference, description of the issue and clear photographs of external packaging, internal packaging, protective materials and product. Packaging and protective materials must be preserved until checks are completed. Failure to cooperate may make a claim with the carrier or insurer more difficult or impossible.

For consumers, the risk of loss or damage passes to the customer only when the customer, or a third party designated by the customer other than the carrier proposed by Ancient Sculptures, physically takes possession of the product, in accordance with mandatory consumer rules. If the customer independently chooses a carrier not proposed or arranged by Ancient Sculptures, risk may pass when the product is handed over to that carrier, to the extent permitted by law.

For professional customers, risk is governed by applicable law and any written agreement between the parties. Mandatory consumer rights and non-excludable liabilities remain unaffected.

10 Consumer withdrawal and returns

Where the customer is a consumer and the purchase is a distance contract, the customer has the right to withdraw without giving any reason within the period provided by applicable consumer law, unless a legal exception applies. For EU consumers, this period is generally fourteen (14) days from delivery.

Withdrawal must be notified by a clear statement sent to info@ancient-sculptures.com, indicating the Order, product and customer details.

If withdrawal is validly exercised, the product must be returned within the legal time limit, in the same condition in which it was received, except for handling necessary to establish its nature, characteristics and functioning. Certificates, documentation, accessories and materials received with the product must also be returned.

Because many products are fragile, valuable or non-standard, the customer must request and follow return instructions before shipping the product back. The return must use suitable packaging, handling, insured transport where reasonably required and methods appropriate to the nature, value and fragility of the product.

Unless Ancient Sculptures agrees otherwise or the law requires otherwise, direct return costs are borne by the customer, provided this obligation has been communicated in accordance with applicable law. The customer may be liable for diminished value caused by handling beyond what is necessary, inadequate packaging, negligent handling or unsuitable return methods. Mandatory consumer rights remain unaffected.

11 Legal guarantee of conformity

For consumers, products are covered by the legal guarantee of conformity provided by applicable consumer law. This guarantee cannot be excluded by these Terms.

Conformity is assessed in light of the nature of the product sold. Antique, artistic, restored, used or non-standard items must be evaluated considering age, condition, materials, restorations, documented characteristics and information provided in the product page, photographs, certificate and documentation.

Disclosed signs of age, wear, restorations, imperfections, irregularities, colour variations, missing parts, integrations or limitations do not constitute lack of conformity merely because they are present.

Material undisclosed differences concerning essential characteristics, such as material, dimensions, period, attribution, provenance, condition, certificate or documentation, may be assessed under applicable law.

The customer must notify alleged lack of conformity or material discrepancy at info@ancient-sculptures.com, providing order reference, description and adequate evidence where relevant. Mandatory rights and remedies remain unaffected.

12 Use, placement, maintenance and special services

Antique, artistic and decorative objects may require careful handling, suitable placement and appropriate conservation conditions. Certain products may be fragile, heavy, structurally delicate or sensitive to humidity, heat, direct sunlight, water, frost, chemicals, aggressive cleaning or unsuitable environments.

After delivery, the customer is responsible for handling, storing, placing, maintaining and using the product with due care and consistently with its nature, age, materials, condition and any information provided.

For heavy, unstable, fragile or decorative products, the customer should use qualified personnel for handling, positioning, mounting, installation or adaptation. Ancient Sculptures is not liable for damage, deterioration, accidents or loss of value caused by improper handling, unsuitable placement, incorrect installation, inappropriate use, lack of maintenance, aggressive cleaning, environmental conditions or third-party interventions after delivery, except where liability cannot be excluded by law.

Unless expressly agreed in writing, the sale does not include delivery to floor, unpacking, installation, mounting, fixing, adaptation, restoration, conservation work, structural assessment or any special service beyond sale and shipment according to the agreed delivery method. Special services must be agreed separately and may be subject to additional costs and technical checks.

13 Direct collection, deposits and special payment arrangements

Direct collection, shipment through a customer-appointed carrier, deposits, reservations, temporary holds or deferred payments are permitted only if expressly agreed in writing by Ancient Sculptures.

If the customer appoints a carrier not proposed or arranged by Ancient Sculptures, the customer must ensure that the carrier is suitable for the product’s nature, value, fragility, dimensions and weight. Ancient Sculptures is not liable for damage, loss, delay or improper handling caused by that carrier, except where liability cannot be excluded by law.

Storage, return, re-delivery, handling or administrative costs caused by the customer’s failure to collect, refusal of delivery, incorrect information or unavailability may be charged to the customer where attributable to the customer and permitted by law.

Any deposit, reservation, hold or deferred payment is governed by the written conditions communicated to the customer. Unless agreed in writing, submitting an Order, requesting information, attempting payment or communicating with Ancient Sculptures does not reserve the product.

14 Anti-fraud, KYC, anti-money laundering and sanctions checks

Ancient Sculptures may carry out checks reasonably necessary or appropriate in relation to the Order, payment, customer identity, destination, transaction value, legal obligations, fraud prevention, anti-money laundering rules, sanctions, export controls or other compliance requirements.

Ancient Sculptures may request identity documents, company details, tax information, beneficial ownership information, proof of authority, payment clarification, confirmation of payer identity, shipping destination or other information reasonably required.

Ancient Sculptures may suspend, refuse or cancel an Order if the customer does not provide requested information, if information is incomplete or unverifiable, if payment is irregular or suspicious, if the transaction involves sanctioned persons, restricted countries or prohibited destinations, or if completion may expose Ancient Sculptures to legal, regulatory, financial or reputational risk.

Personal data collected for these purposes are processed in accordance with applicable data protection laws and the Privacy Policy.

15 Website use, accounts, intellectual property, privacy and third-party services

The customer must use the website lawfully and correctly. It is prohibited to provide false information, attempt unauthorised access, interfere with checkout, forms, servers or security systems, carry out unauthorised mass scraping, copy content unlawfully or use the website in a way that damages Ancient Sculptures, users, transactions or the catalogue.

Where customer accounts are available, the customer is responsible for accurate account data and confidentiality of login credentials. Ancient Sculptures may restrict or suspend an account used unlawfully, fraudulently, in breach of these Terms or in a way that may compromise website or transaction security.

Texts, photographs, product descriptions, catalogue information, logos, graphics, videos, layout and website content are protected by intellectual property rights or other applicable rights. The customer may use them only for personal consultation and purchase-related purposes. Purchasing a product does not transfer rights over photographs, descriptions, catalogue materials, trademarks, logos or website content.

Ancient Sculptures may rely on third parties for payments, banking services, shipping, insurance, customs procedures, hosting, technical maintenance and other services. Third parties may apply their own procedures, checks, processing times or costs. Ancient Sculptures is not liable for issues caused exclusively by such third parties, except where liability cannot be excluded by law.

Personal data are processed in accordance with the Privacy Policy available on the website. Cookies and similar technologies are governed by the Cookie Policy available on the website.

16 Assistance, complaints and dispute resolution

For assistance, product information, orders, payments, shipping, returns, withdrawal requests, complaints or transport damage, the customer may contact info@ancient-sculptures.com.

The customer should provide all information needed to handle the request, including order number, product reference, customer details, description of the issue and photographs where relevant.

Ancient Sculptures will examine complaints in good faith and respond within a reasonable time, considering the nature of the request and any checks needed with couriers, insurers, payment providers, customs offices or other parties involved.

The customer retains the right to use any consumer protection procedure, alternative dispute resolution mechanism, mediation procedure, court or competent authority available under applicable law.

17 Promotions, written agreements and document hierarchy

Promotions, vouchers, discounts, special offers or promotional codes apply only under the conditions stated at the time of the offer. Unless stated otherwise, they are not cumulative, cannot be exchanged for cash and do not apply to shipping, insurance, customs duties, import taxes, bank charges, special packaging, storage, handling or other additional costs.

These Terms, together with the product page, certificate or documentation, accepted shipping quotation, definitive order confirmation and any specific written agreement, form the contractual framework for purchases through ancient-sculptures.com.

In case of inconsistency, unless required by law or agreed otherwise in writing, the order of priority is: specific written agreement accepted by both parties; definitive order confirmation; accepted shipping quotation or updated cost communication; product page; certificate or documentation within what is expressly stated therein; these Terms; general commercial, promotional or informational communications.

Any waiver, exception, additional commitment, modification or special condition is valid only if made in writing and expressly accepted by Ancient Sculptures.

18 Applicable law, final provisions and specific approval

These Terms and any sales contract entered into through ancient-sculptures.com are governed by Italian law, without prejudice to mandatory consumer protection rules that may apply under the customer’s country of residence or other applicable mandatory law.

For consumers, disputes shall be submitted to the courts having jurisdiction under mandatory consumer protection rules. For professional, business or non-consumer customers, disputes shall be submitted to the competent courts under applicable law, unless a different jurisdiction is validly agreed in writing.

Ancient Sculptures may update these Terms to reflect legal, technical, operational or service changes. The version applicable to an Order is the version accepted by the customer when submitting the Order, unless a later change is required by mandatory law or expressly agreed in writing. Changes do not apply retroactively to Orders already definitively accepted, unless required by law or agreed with the customer.

Ancient Sculptures is not liable for delays, suspension or non-performance caused by events beyond its reasonable control, including natural disasters, fires, floods, wars, riots, strikes, transport interruptions, customs blocks, import/export restrictions, government measures, health emergencies, courier or carrier failures, payment provider failures, exceptional technical failures, impossibility of obtaining permits or any event making performance impossible, unlawful, excessively delayed or materially different from what was reasonably foreseeable, without prejudice to mandatory rights and remedies that cannot be excluded under applicable law.

If any provision is invalid, unlawful or unenforceable, the remaining provisions remain valid and enforceable. The affected provision shall be interpreted or replaced, to the extent permitted by law, in a way that most closely reflects its original purpose while remaining valid.

No limitation or exclusion of liability in these Terms applies in cases of wilful misconduct, gross negligence, fraud, death or personal injury caused by the Seller’s negligence, or any other liability, right or remedy that cannot be excluded or limited under applicable law.

Where required by applicable law, the customer may be asked to expressly approve specific clauses concerning order verification and cancellation, shipping cost verification, limitations of liability, force majeure, transfer of risk, return procedures, customer obligations, anti-fraud and compliance checks, applicable law and jurisdiction, or other clauses requiring specific acceptance.

If another language version is made available and there is any inconsistency, the version expressly indicated by Ancient Sculptures as prevailing shall apply, without prejudice to mandatory rights under applicable law. For anything not expressly regulated by these Terms, applicable law shall apply.
